Liability Waiver & Medical Waiver for The Rising Retreat

This Liability Waiver and Medical Waiver (the “Waiver”) is executed by the undersigned (“Participant”) in favor of Conor Millstein, Kyle Kingsbury, ISO Movement, and any associated personnel, volunteers, and third parties (collectively referred to as the “Released Parties”) in relation to participation in The Rising Retreat (the “Retreat”) held on August 27, 2025 - September 1, 2025.

1. Assumption of Risk

The Participant acknowledges that participation in the Retreat involves physical activities, including but not limited to movement education, combat sports, fasting, sauna use, and outdoor activities. The Participant understands and voluntarily accepts the inherent risks involved in these activities, including potential injury, illness, or adverse physical effects, and agrees to fully assume all such risks.

2. Waiver of Liability

The Participant hereby releases and holds harmless Conor Millstein, Kyle Kingsbury, ISO Movement, the farm property, and any of the Released Parties from any and all liability, claims, damages, or causes of action for any injury, loss, or damage that may arise from participation in the Retreat, whether caused by negligence or otherwise. This includes, but is not limited to, physical injuries, mental or emotional distress, and any damages incurred during the Retreat.

3. Medical Waiver

The Participant affirms that they are in good physical and mental health and capable of participating in the Retreat’s activities. The Participant acknowledges that it is their responsibility to consult with a physician or healthcare professional prior to participation if there are any concerns regarding their ability to safely engage in the activities.

In the event of a medical emergency, the Participant consents to the provision of emergency medical treatment if necessary and agrees to bear all costs associated with such treatment. The Participant further agrees to indemnify and hold harmless the Released Parties from any claims arising from medical care provided.

4. No Refunds & Final Sale

The Participant acknowledges that all payments for the Retreat are final, non-refundable, and non-transferable. This includes, but is not limited to, the cost of participation, accommodations, meals, and any additional fees associated with the Retreat. By signing up, the Participant agrees to these terms and understands that no exceptions will be made.

5. No Transfers

The Participant agrees that they may not transfer their participation to another person. Any attempt to transfer, assign, or sell the participation in the Retreat will result in cancellation without a refund.

6. Force Majeure

The Released Parties shall not be held liable for any failure to perform under this agreement if such failure is caused by an event beyond their control, including but not limited to natural disasters, pandemics, or governmental restrictions, which may impact the ability to hold the Retreat as planned.

7. Compliance with Rules and Regulations

The Participant agrees to comply with all rules, regulations, and safety protocols set forth by the Retreat organizers and venue. Failure to adhere to these rules may result in the immediate removal of the Participant from the Retreat without refund.

8. Photography & Media Release

The Participant hereby grants permission to Conor Millstein, Kyle Kingsbury, ISO Movement, and any of their agents or affiliates to capture photographs, video, and audio recordings of the Participant during the Retreat. The Participant acknowledges and agrees that these materials may be used in marketing, promotional, or educational materials, including but not limited to websites, social media, printed brochures, and other marketing channels, without compensation or further approval.

The Participant waives any right to inspect or approve the finished product, and acknowledges that these materials may be edited and used as the Released Parties see fit. This includes permission to use the Participant’s name, likeness, and voice in connection with the Retreat and promotional activities related to the Retreat.

9. Governing Law and Dispute Resolution

This Waiver shall be governed by and construed in accordance with the laws of [Your State], without regard to its conflict of laws principles. Any disputes arising from or related to this Waiver shall be resolved through binding arbitration in [Your State], and the prevailing party in any such action shall be entitled to reasonable attorney’s fees and costs.

10. Acknowledgment and Agreement

By signing below, the Participant acknowledges that they have read and fully understand the terms of this Waiver. The Participant voluntarily agrees to be bound by these terms and participates in the Retreat at their own risk. The Participant affirms that they are signing this Waiver freely, without coercion, and with full understanding of the consequences.

Terms and Conditions for The Rising Retreat

1. Registration and Payment

   • All registrations for The Rising Retreat are final and non-transferable. Upon registration, full payment is due, and access to the Retreat will only be granted once payment is complete.

2. Refund Policy

   • Payments made for The Rising Retreat are final and non-refundable. No exceptions will be made for cancellations, no-shows, or changes in plans. The Participant acknowledges and agrees to this policy at the time of booking.

3. Event Changes

   • ISO Movement reserves the right to make changes to the event schedule, including but not limited to location, speakers, and activities, in the event of circumstances beyond their control.

4. Code of Conduct

   • All participants are expected to behave in a respectful and responsible manner throughout the Retreat. Any participant who disrupts the experience or engages in unsafe or inappropriate behavior will be removed from the event without refund.

5. No Liability

   • ISO Movement, Conor Millstein, Kyle Kingsbury, and associated personnel are not liable for any injury, loss, damage, or illness sustained during the Retreat, whether resulting from negligence, actions of others, or unforeseen events.

6. Force Majeure

   • ISO Movement will not be liable for failure to perform under these terms due to events beyond their reasonable control, including but not limited to natural disasters, government restrictions, or unforeseen emergencies.

7. Media Release

   • By participating in The Rising Retreat, the Participant grants permission for ISO Movement and its representatives to capture photos, videos, and audio of the participant for promotional and educational purposes, without compensation.

By participating in The Rising Retreat, you confirm that you have read, understood, and agree to these Terms and Conditions and Liability Waiver.
